Decisions, Decisions: Deciding Between Medicaid and VA Pension

Elder law attorneys must simultaneously navigate between VA Pension Benefit rules and Medicaid rules at four key times:
1) Initially deciding whether to apply for VA or Medicaid, or both
2) A VA case matures into a Medicaid case, whether within Medicaid’s lookback period or not
3) Medicaid eligibility is obtained, impacting VA eligibility
4) Determining how Medicaid’s rules treat a VA Pension Benefit, including during initial eligibility determination, during patient responsibility calculation, and during estate recovery.
This presentation will highlight the process for successfully navigating each of these periods.
