ElderCounsel adds annotated document feature to its trust documents

We are thrilled to announce that the latest update to ElderDocx® includes a new and exciting feature: annotated documents! This feature is available for the Medicaid Asset Protection Trust (MAPT), Veterans Asset Protection Trust (VAPT), Medicaid Family Protection Trust (MFPT), Revocable Living Trust (RLT), and Standalone Will. What is an annotated document?  An annotated document allows an attorney to create a trust with footnotes explaining the legal features of the trust. It also enables attorneys to quickly switch to a client summary that puts the relevant terms of the trust into easy-to-understand terms. In this quick tutorial, ElderDocx Senior Programmer Karen Walker walks you through an annotated document. To enable this new feature from the ElderDocx intervie... Read More

ElderCounsel Principal Attends Signing at White House

ElderCounsel Principal Michael Amoruso and his Seeing Eye Dog, Demitri, were present yesterday for the signing of the 21st Century Cures Act.  A major part of this Act was the Special Needs Trust Fairness Act, which now allows disabled persons to establish and sign their own special needs trust. Previously, only a parent, grandparent, guardian or court could establish such a trust. Michael was instrumental in advocating for passage of the Special Needs Trust Fairness Act, encouraging the National Academy of Elder Law Attorneys (NAELA) to get involved. "Getting the Special Needs Trust Fairness Act passed has been a long-standing priority for me, spanning the last 23 years,” said Amoruso. “I am very grateful to NAELA for spearheading the effort to get these prov... Read More

    Introducing ElderDocx Help Videos

    By Brian Albee, J.D.

Earlier this year I spent some time in front of a camera along with ElderCounsel CEO, Valerie Peterson, J.D. Together we created 65 help videos for ElderDocx. We are happy to announce the most recent enhancement to ElderDocx includes these videos! Topics range from when to use a joint trust to an explanation of grantor-trust choices in a Medicaid Asset Protection Trust.  We know time is valuable and limited so these videos are as short as possible and focus on the exact item you are working within ElderDocx. Videos range in length from 30 seconds to 4 minutes. ElderCounsel Members are encouraged to open ElderDocx and check out the new videos sprinkled throughout the interviews where they are relevant.  Below is an example of one help video in ElderDocx regarding d... Read More

    Symposium 2016 Recap and Highlights

Last week WealthCounsel & ElderCounsel hosted Symposium 2016 in Reston, Virginia. Attendees enjoyed 3 ½ days packed with robust education, valuable networking, dynamic presenters, and dozens of practice solutions featured in the exhibit hall. Symposium 2016 encouraged interaction in every session, as well as thought-provoking topics designed to help attendees become even more successful, despite a changing marketplace. This year was the first year we had a custom conference app available to attendees. This savvy app helped attendees know what events were taking place, granted access to session materials, and allowed everyone to stay connected, even if they weren’t in the same session. The app activity feed was lively—many shared photos and status updates. Throug... Read More

ElderCounsel Makes Same Sex Planning Easy for Attorneys

ElderCounsel®, a membership organization supporting elder law, special needs and VA Pension attorneys, has announced an expansion of their document drafting assembly system, ElderDocx®, to include tools that are geared to helping attorneys plan more effectively for same sex couples as well as any couple who are unmarried but living together, particularly when children are involved.   With the Supreme Court Defense of Marriage Act ruling in 2013 allowing same sex couples to marry, the need for estate planning documents for same sex couples has never been greater. Additionally, as the number of unmarried other-sex couples continues to grow, planning documents for this segment of the population need to reflect the most up to date planning strategies available.
